If your divorce is final, but your circumstances have changed dramatically, the child custody, parenting time or support orders that are in place may no longer be workable. Custody Modification

To change an existing custody order, you must provide proof that there has been a substantial change in your circumstances and that a change will be in the best interests of the child. The court is more likely to grant a request for custody modification when

  • One of the parents is experiencing personal problems that affect the child
    • Substance abuse
    • Domestic violence
    • Criminal investigation or arrest
  • The non-custodial parent will provide a better home or lifestyle for the child
    • Improved education opportunities for child
    • More stable home environment
  • The child is having trouble at the custodial home
    • Neglect, truancy or delinquency issues

Changes to Parenting Time Agreements

An existing parenting time agreement will only be changed if the court determines doing so is in the child's best interests. The court will balance the needs of both parents with the needs of the child. If one of the parents relocates, the court will consider forms and costs of transportation when revising the parenting time agreement.

Amendments to Child Support Orders

Because child support is calculated based on the respective incomes of both parents, any change will be based on either a change in income or a change in the financial needs of the custodial parent. Spousal Support Modifications

When there is a request to modify an alimony decree, the court will balance the needs of each party, examining whether there has been a change in the circumstances that warranted the original grant of alimony. I will make certain that any proposed revisions are consistent with Oregon law.
