In Oregon, the court will almost always recommend mediation as a way to develop a workable child custody or parenting plan. I will help you prepare for mediation, making certain you know what to expect, what your rights are and when it is in your best interests to cooperate. A successful outcome through mediation can save money and time, and can minimize stress and anxiety.

Child Custody

When formulating a child custody agreement, you need to consider both legal custody and physical custody. Physical custody refers to where the child will actually reside. Legal custody addresses the right to make decisions about important matters in the child's life, such as health care, education and day care. The courts tend to grant physical custody to one parent, but give legal custody jointly to both.

When working with you to develop a child custody plan, I will always place a priority on the best interests of your child. However, at the same time, I will work to put in place provisions that protect your rights as a parent.

Parenting Time or Visitation

Though the Oregon courts prefer that parenting time agreements come through mediation, you should not assume that you will be able to work something out with your ex-spouse. I will make certain you understand what your rights are before you start mediation, so that you have the best chance of a meaningful relationship with your children. If the distance between you and your ex-spouse requires significant travel for parenting time, I will work to see that the costs of travel are equitably shared.
