Alternative Dispute Resolution
During a client interview, I may discuss mediation or other alternative dispute resolution methods as an option to resolve family law matters. While the adversarial process is always an option, clients may seek alternative dispute resolution methods to accomplish their goals.
I have begining as a collaborative Family Lawyer. I am an experienced mediator and can help you explore other methods of conflict resolution.
Mediation
I can meditate or serve as your counsel if you mediate using another profession. As your attorney, I will provide legal counsel and review and settlement proposals created during mediation.
The scope of your mediation depends on the issues you need to resolve. Mediation, is often used resolve issues related to your children and/or your property. While I can offer suggestions for settlement, you issually set the rules and establish the issues addressd in your mediation.
Mediation may take several sessions in order to work out all the issues you wish to resolve. Common issues include:
- Child custody and parenting time
- Establishing child support
- Establishing spousal support/alimony
- Division of property and debt
Collaborative Divorce
Some people may pursue a collaborative approach because they want to cooperatively resolve issues based on shared concerns and needs. Although the parties may not want to continue their relationship, they hope the process will generate two separate and loving home environments for the children. The collaborative process often helps make the transition easier on the whole family often leads to a better post-separation relationship.
In the collaborative setting, the parties and their attorneys usually meet together in a room to resolve divorce issues. You may choose to work with other collaborative professionals such as accountants, parenting experts and parenting coaches.
